What We Handle for Subdivisions
Plan of subdivision review
We check the surveyor’s plan against title, planning permit conditions, and council requirements before it goes to certification.
Section 32 statements for new lots
Once new titles issue, you’ll need a Section 32 Vendor Statement for each lot you sell. We prepare them promptly so you’re ready to go to market.
Council and SPEAR coordination
We manage the lodgement and tracking of your plan through SPEAR and liaise with council on certification requirements and any outstanding conditions.
Statement of Compliance handling
We coordinate with service authorities and council to progress the Statement of Compliance, the key document that unlocks plan registration.
Lodgement with Land Use Victoria
Once the Statement of Compliance is issued, we lodge your Plan of Subdivision with Land Use Victoria and track it through to registration.
Contracts of sale for each new lot
Selling one or more of the new lots? We prepare the contracts and manage each settlement, whether through PEXA or otherwise.
What Is a Plan of Subdivision?
A Plan of Subdivision is the legal document that creates new lots from an existing parcel of land. Under the Subdivision Act 1988 (Vic), the plan must be prepared by a licensed land surveyor, certified by the local council, and registered with Land Use Victoria before any new Certificates of Title can issue.
The plan sets out the boundaries of each new lot, any easements or covenants, and whether an Owners Corporation will be created to manage shared property. It is the document that makes the subdivision legal. Without a registered plan, the new lots cannot be sold or mortgaged separately.
Common inclusions on a Victorian Plan of Subdivision:
- Lot numbers and boundary dimensions
- Easements for drainage, sewerage, or access
- Common property shared between lots (driveways, gardens)
- Owners Corporation details, if one is being created
- Road dedications or reserve boundaries
Once your surveyor has lodged the plan through SPEAR and council has certified it, we take over the legal steps and manage the process through to title issue.

Council certification
Council reviews the plan against planning permit conditions. We follow up on any outstanding requirements and coordinate with service authorities to progress the Statement of Compliance.

Statement of Compliance and lodgement
Once council issues the Statement of Compliance, we lodge the plan with Land Use Victoria. Registration typically takes two to four weeks from lodgement.

Common Questions About Subdivision Conveyancing
What does a conveyancer do for a subdivision in Victoria?
A conveyancer manages the legal steps from plan certification through to title issue. This includes reviewing the Plan of Subdivision, obtaining mortgagee consent, coordinating with your surveyor through SPEAR, and lodging the plan with Land Use Victoria once the Statement of Compliance is issued. If you are selling the new lots, we prepare each Section 32 Vendor Statement and manage settlement too.
Do I need a conveyancer to subdivide my land in Victoria?
You are not legally required to use a conveyancer, but the lodgement process with Land Use Victoria involves legal documents that most landowners cannot prepare themselves. Almost all subdivisions are handled by a conveyancer or solicitor. We also identify issues early, such as undisclosed encumbrances, drainage easements, or mortgagee consent requirements, before they delay registration.
What’s the difference between what the surveyor does and what the conveyancer does?
The surveyor measures the land, designs the lot layout, prepares the Plan of Subdivision, and lodges it through SPEAR. The conveyancer handles the legal side: reviewing the plan, obtaining consents, managing the Statement of Compliance process, lodging with Land Use Victoria, and preparing sale contracts for the new lots. Both roles are essential and must work together.
How long does subdivision conveyancing take in Victoria?
The full subdivision process from planning permit to new titles typically takes six to eighteen months depending on council, site complexity, and how quickly the Statement of Compliance is issued. The conveyancing steps from plan certification through to title registration usually take two to four months. We keep you updated at each milestone.
How much does subdivision conveyancing cost?
Conveyancing fees for a residential two or three lot subdivision typically range from $1,500 to $3,000 plus disbursements such as Land Use Victoria lodgement fees, title searches, and council certificates. We provide a fixed-fee quote upfront. If your land is in a growth corridor such as Wyndham or Casey, a Growth Areas Infrastructure Contribution (GAIC) may also apply and we flag this early.
Will I need a Section 32 for each new lot when I sell?
Yes. Under the Sale of Land Act 1962 (Vic), every property sale requires a Section 32 Vendor Statement prepared before the contract is signed. If you are subdividing to sell, we prepare each Section 32 as part of the same engagement. Our free 24-hour contract review is also available throughout the process.
