Local Conveyancing for Essendon Buyers and Sellers

Essendon is one of Melbourne’s established inner-north-west suburbs, about 8km from the city, and it is known for its grand Edwardian and Federation homes. Around them, apartment and townhouse projects keep adding to the mix, and the Essendon Fields precinct next to the old airport has become a busy retail and business hub with a DFO on its edge.

That blend of heritage houses and new development is where contracts get complicated. Many Essendon streets sit under a Heritage Overlay, and the homes being subdivided for units bring their own set of title questions. Neither is obvious when you inspect a property.

Our job is to check the Contract of Sale and Section 32 line by line, so you know what you are buying before you sign. Reviews are free and turned around within 24 hours.

What Essendon Buyers Should Check

Two issues come up again and again on Essendon contracts, and both can change what you are allowed to do with a property.

Heritage Overlays on Period Homes

Essendon has some of the densest heritage coverage in the area, with a Heritage Overlay applied to individual homes and to whole period streetscapes. The council reviewed and added to these controls through its 2023 heritage study, so some streets carry newer protections than buyers expect.

A Heritage Overlay can require a planning permit to demolish, extend or change the outside of a home, and it can limit subdivision.

Why it matters: if you plan to renovate or develop, the overlay decides what is possible. We read the planning certificate and flag any Heritage Overlay before you are locked into the contract.

Subdivisions, Units and Owners Corporations

A lot of newer Essendon stock is apartments and townhouses built on subdivided blocks. These titles usually come with an Owners Corporation, shared driveways and drainage or sewerage easements, and buyers of a development site need to check what the zoning and any covenant actually allow.

Why it matters: Owners Corporation fees, rules and the plan of subdivision all change what you own and what it costs to hold. We check the title, the plan of subdivision and the Owners Corporation certificate so there are no surprises after settlement.
