What We Handle for Sellers

Section 32 Vendor Statements

Title searches, council certificates, planning details, owners corporation records. We pull it all together in a form that holds up to scrutiny.

Auction & Private Sale Contracts

Whether you’re going to auction or accepting offers privately, we tailor the Contract of Sale to suit your method and timeline.

Disclosure & Legal Compliance

Every Section 32 is checked against the Sale of Land Act 1962 (Vic) so you’re protected from claims long after settlement.

All Property Types

Houses, units, apartments, serviced apartments, retirement accommodation, vacant land, commercial premises, industrial properties, company share transactions and rural blocks.

Settlement Coordination

We work with the buyer’s conveyancer, your bank and PEXA to make sure funds clear and the title transfers on the date in the contract.

Same-Day Communication

Every email, every call, every question gets a same-day response. You’ll always know exactly where your file is up to.

What Is a Section 32 Vendor Statement?

A Section 32 Vendor Statement (sometimes called a Vendor’s Statement) is a legal document required under the Sale of Land Act 1962 (Vic). It must be given to every prospective buyer before they sign a contract.

The document discloses key information about your property, including:

  • Title details and any mortgages or encumbrances
  • Planning and zoning information
  • Outgoings such as council rates, water rates and owners corporation fees
  • Building permits issued in the last seven years
  • Any notices from council or government authorities

If a Section 32 is incomplete or contains errors, the buyer can rescind the contract right up until settlement, leaving you back at square one. That’s why getting it right the first time matters.

The Selling Process, Step by Step

1

Engage us early

The earlier we start, the smoother things go. Ideally, get in touch before you sign with a real estate agent so we can have your Section 32 ready when the property hits the market.

2

Section 32 preparation

We pull the title, run searches with council and water authorities, request owners corporation certificates if applicable, and prepare a complete Vendor Statement and Contract of Sale.

3

Property goes to market

Once your Section 32 is signed, your agent can legally market the property and provide the documents to interested buyers.

4

Offer accepted or auction result

When a buyer is locked in, we receive the signed contract, confirm settlement dates and start the wind-down to settlement. If you need the deposit before settlement, we can request an early deposit release under Section 27.

5

Settlement day

We coordinate with the buyer’s conveyancer, your bank, and the State Revenue Office through PEXA. Funds clear, the title transfers, and the property is officially sold.

Common Questions From Sellers

How much does a conveyancer cost when selling a property in Victoria?

Conveyancing fees for sellers typically range from $800 to $1,500 plus disbursements (title searches, council certificates and similar). We provide a quote upfront so there are no surprises. Call us for a same-day quote.

Do I need a Section 32 before I list my property?

Yes. Under the Sale of Land Act 1962 (Vic), you cannot legally accept an offer without a signed Section 32 in place. We can usually have one ready within a week of engagement.

What happens if my Section 32 has a mistake?

If a buyer discovers a material omission or error in your Section 32, they can rescind the contract at any point up to settlement. The result is a failed sale, often months in. Our process is built to catch issues before the document goes out.

How long does settlement take after a contract is signed?

Standard settlement in Victoria is 30, 60 or 90 days from the contract date, but any timeframe can be negotiated with the buyer. We’ll work to whatever date is in the contract.

Can I sell privately without a real estate agent?

Yes, and we work with private sellers regularly. You’ll still need a Section 32 and a Contract of Sale, and we can prepare both. Just keep in mind that managing buyer enquiries and negotiations falls to you. Our private sale conveyancing page sets out what stays with you and what we take care of. Our guide to selling a house privately in Victoria walks through the steps in the order they happen.

What’s the difference between auction and private sale contracts?

Auction contracts have no cooling-off period and cannot be subject to finance. Private sale contracts include a three-business-day cooling-off and can be conditional on finance, building inspection or other terms. We tailor the contract to match your sale method.

Can I sell my Victorian property if I’m overseas?

Yes. The whole process can be handled electronically through PEXA, and contracts can be signed digitally. What matters for tax is your residency, not where you live. Since 1 January 2025 every Australian resident seller needs an ATO clearance certificate at any sale price, or the buyer must withhold up to 15% of the proceeds at settlement. If you are a foreign resident for tax purposes, withholding applies unless the ATO grants a variation. We’ll guide you through whichever applies.

Can you review a contract before I engage my own conveyancer?

Yes, and it’s free. We offer a 24-hour Section 32 and Contract of Sale review at no charge, with no obligation to engage us afterwards.
